The trial finally started on December 8th and ran

which the Court had no control.

the first break down occurred on February 19th

when Mr. Sharp announced his appointment as Chairman of the

Military Service Commission. he stated, and I agreed with him

that it would be at first impossible to combine his new duties

with his Court work. But it was unqertain how long the sittings

of the Commission would continue and he asked for breaking time,

hoping to get over the initial heavy work and resume the case

at an early date. I agreed then to let the hearing stard over

from week to week till it should appear how things would turn out.

Here the criticism may be made that I should have

refused any adjournment and continued the case with Mr. Jenkin.

The answer is that Mr. Jenkin has great ability

and shows very great promise. Hewill in no long time be a first

class advocate. But he lacks experience necessary to handle such

a heavy case unaided, and he was already showing signs of strain.

The oase stood over then until March 5th when

it became apparent that Mr. Sharp's absence would be indefinite.

The Hearing then continued its ordinary course

until May 21st when the break up began. The Official receiver on

that date discovered he was not secured for his costs and could

not therefore proceed.

Unless the whole proceedings were to end in a

fils00,

an adjournment was necessary, and this of course I gave,

though it was hotly resisted by the other side.

On May 30th the Crown intervened: Les Hysan and

Ma Ches Lung were arrested and the Attorney General applied that

the hearing might be adjourned sine die ar oriminal proceedings

were to begin at once. Such a termination would have been most

unfortunate: and in the end the Orown determined to give the

Official Receiver the security he desired.

On June 11th Mr. Jenkin who had been visibly over
